DMCA Policy

Overview

GuideTopics (operated by Taciturn Studios LLC) respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), 17 U.S.C. § 512, we will respond promptly to notices of alleged copyright infringement that comply with the DMCA and applicable law.

Reporting Copyright Infringement

If you believe that content on GuideTopics infringes your copyright, please send a written DMCA takedown notice to our designated agent. Your notice must include all of the following elements as required by 17 U.S.C. § 512(c)(3):

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed (or a representative list if multiple works are covered by a single notification).
  3. Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material (e.g., the URL of the specific page).
  4. Your contact information, including your name, address, telephone number, and email address.
  5. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

Counter-Notification Procedure

If you believe your content was removed in error or misidentification, you may submit a counter-notification to our designated DMCA agent. Your counter-notification must include:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access was disabled.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if your address is outside the United States, any judicial district in which GuideTopics may be found), and that you will accept service of process from the person who provided the original notification.

Upon receipt of a valid counter-notification, we will forward it to the original complainant and may restore the removed content within 10–14 business days unless the complainant files a court action.

Repeat Infringers

GuideTopics has a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers of intellectual property rights. We reserve the right to determine what constitutes "repeat infringement" in our sole discretion.

Misrepresentation

Please note that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees.
